1. Acceptance of Terms
By downloading, installing, or using the OnePhone CallFilter application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not download or use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and OnePhone ("we," "our," or "us") governing your use of the CallFilter App.
You must be at least 13 years of age to use this App. If you are under 18, you must have parental or guardian consent to use the App.
2. App Description
CallFilter is an Android application that provides call management features including:
- Blocking spam and unwanted calls by adding specific numbers to a block list
- Creating custom blocking rules using prefix, suffix, or pattern matching to block entire call series
- Identifying unknown callers and displaying caller information
- Providing a built-in dialpad for making outgoing calls
- Maintaining call history and blocking statistics
The App operates primarily on your device and requires certain permissions (as described in our Privacy Policy) to deliver these features.
3. Usage Rules
When using CallFilter, you agree to:
- Use the App only for its intended purpose of managing and filtering your own incoming and outgoing calls
- Not use the App to interfere with emergency calls or calls from emergency services
- Not use the App to harass, threaten, or interfere with the communications of others
- Not attempt to reverse engineer, decompile, or modify the App's code
- Not use the App in any manner that violates applicable laws or regulations
- Not create blocking rules that may prevent legitimate or emergency communications from reaching you
- Not use the App to block calls from law enforcement, government agencies, or other official bodies in a manner that may be unlawful
Emergency Calls: CallFilter is designed to never block emergency numbers (such as 100, 101, 102, 108, 112 in India). However, you are responsible for reviewing your custom blocking rules to ensure they do not inadvertently block important calls.
4. User Responsibilities
As a user of CallFilter, you are responsible for:
- Reviewing Blocking Rules: Regularly reviewing your custom blocking rules, prefix/suffix rules, and pattern matching rules to ensure they are not blocking calls you want to receive.
- Maintaining Your Block List: Keeping your blocked number list up to date and removing entries that are no longer needed.
- Permission Management: Granting the necessary permissions for the App to function and understanding the implications of revoking permissions.
- Device Security: Ensuring your device is secured with appropriate locks and protections, as the App stores blocking rules and call data locally.
- Backing Up Data: Backing up your custom rules and block list, as uninstalling the App will permanently delete all locally stored data.
5. Limitation of Liability
Blocked or Missed Calls: CallFilter is a tool to help you manage calls, but it is not infallible. We are not liable for:
- Legitimate calls that are blocked or silenced due to your custom rules, prefix/suffix rules, or pattern matching rules
- Calls that you miss because they were incorrectly identified as spam
- Any loss, damage, or consequence arising from a blocked or missed call, including but not limited to missed business opportunities, missed emergency notifications, or missed communications from family or friends
- Spam or fraudulent calls that are not detected or blocked by the App
Service Availability: We do not guarantee uninterrupted or error-free operation of the App. The App may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
Maximum Liability: To the maximum extent permitted by applicable law, our total liability to you for any claim arising from or related to the App shall not exceed the amount you paid for the App, which is zero (0) as the App is provided free of charge.
6. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We specifically disclaim:
- Any warranty that the App will be error-free, uninterrupted, or secure
- Any warranty that the App will detect or block all spam, fraud, or unwanted calls
- Any warranty of merchantability or fitness for a particular purpose
- Any warranty that the App will not block legitimate calls
- Any warranty regarding the accuracy of caller identification information
You use the App at your own risk. You are solely responsible for evaluating the suitability of the App for your needs and for any consequences resulting from its use.
7. Updates & Modifications
We may update, modify, or discontinue the App or any feature at any time without prior notice. Updates may include:
- New features or improvements to existing functionality
- Changes to spam detection algorithms or blocking behavior
- Bug fixes and security patches
- Changes to the user interface or settings
- Removal of deprecated features
We may also update these Terms from time to time. When we make material changes, we will notify you through the App or by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the revised Terms.
We reserve the right to discontinue the App with reasonable notice. In the event of discontinuation, we will provide you with an opportunity to export your data before the App becomes unavailable.
8. Termination
By You: You may stop using the App at any time by uninstalling it from your device. Uninstalling the App will delete all locally stored data, including your blocked number lists, custom rules, and call history.
By Us: We may terminate or suspend your access to the App if:
- You violate these Terms
- You use the App in a manner that is unlawful or harmful
- We are required to do so by law or legal process
- The App is being discontinued
Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including the limitation of liability, disclaimer of warranties, and governing law sections.
9. Intellectual Property
All intellectual property rights in the App, including but not limited to the App name, logo, design, code, graphics, and documentation, are owned by or licensed to OnePhone.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:
- Copy, modify, or distribute the App or any part of it
- Use the App's name, logo, or branding without our prior written consent
- Reverse engineer, decompile, or disassemble the App
- Create derivative works based on the App
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising out of or in connection with these Terms or the App shall be resolved as follows:
- Informal Resolution: You agree to first attempt to resolve any dispute by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.
- Arbitration: If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English and the seat of arbitration shall be in India.
- Jurisdiction: Subject to the arbitration provision above, the courts of India shall have exclusive jurisdiction over any legal proceedings arising from these Terms.
